Kimberly C. Betterton
Kimberly C. Betterton focuses on federal tax laws and regulations involving tax-exempt bonds. Ms. Betterton has worked on numerous types of tax-favored transactions, including governmental, 501(c)(3), exempt facility, single family housing, small issuer manufacturing, and qualified redevelopment obligations. She has previously advised clients on QZABs, QECBs, QSCBs and new CREBs while those types of bonds were able to be issued. She advises clients regarding the original issuance of obligations, the many post-issuance compliance responsibilities, and IRS audits. Ms. Betterton’s broad-ranging experience includes routinely providing counsel on private use questions, arbitrage issues, Form 990 – Schedule K, remediation as a result of change in use, reissuance, and IRS audit and review activities.
Ms. Betterton is nationally recognized in the field of tax-exempt bonds, writing extensively on tax topics and speaking regularly at events focused on financial taxation of municipal bonds. That includes regular participation at the National Association of Bond Lawyers’ (NABL) Workshop, including on panels related to Hot Tax Topics, Tax Due Diligence & Documentation, Private Activity Bond Tests, Working Capital Financings and Bond Opinions, as well as speaking at NABL’s Institute, and Lorman, AICPA, Pennsylvania Association of Bond Lawyers, and Maryland Government Finance Officer Association events, among others. She was the chairperson of NABL’s 2010 Bond Attorneys’ Workshop. She is also the former editor-in-chief of Federal Taxation of Municipal Bonds from LexisNexis, and co-editor of ABCs of Arbitrage: Tax Rules for Investment of Bond Proceeds by Municipalities published by the ABA.
Ms. Betterton was a member of the Board of National Association of Bond Lawyers, 2009-2010, 2011-2013.
